Meaning of Education Essay

â€Å"Yep, that’s the last of it† my dad yelled as he slammed the trunk shut. Totes were piled up high and filled with clothes, shoes, and lots of old memories. After getting all settled in my new apartment my family and I said our goodbyes. This next chapter in my life was finally here. I was now a college student entering the real world. We all have our purposes for taking the next step in life and going to college. My purpose for attending college is to take a leap towards creating success and meaning in my life. My family has been a giant influence on attending college. The day my older brother went off to college it was no surprise. It seems that moving on to college was the natural thing to do. For instance, graduating kindergarten and moving to the 1st grade is similar to graduating from high school and moving on to college. It’s just a chapter in life that our parents brought us up expecting to reach and we’ve been taught that it would be the right choice since elementary school. It’s what we grew up knowing we were supposed to do when we got to that point in life. Ultimately, we were taught that this step would lead us to the success to building a more meaningful life. All in all, education is the key to success. Having an education opens many doors to amazing opportunities. Why waste time stuck in a slump when one can go out into the world and be someone, make a difference in this world, and have the pride to say that â€Å"I am successful†. With a college education, the amount of freedom is endless. There are many more careers to choose from and the ability to stand out from others increases your career success. An education helps one develop a more meaningful life, that’s what I want to achieve. I want to make a difference in this world by not only my art but my everyday life. My goals are to one day be very well off financially, enabling me to support my future family and enjoy all the accomplishments and great opportunities life has to offer. Just on a walk to school, I get a glance of the harsh reality by seeing all the unfortunate civilians struggling to survive each day. For instance, an old man and his dog, hungry as can be, asking for money on the corner of the street. This makes me realize that I am very grateful for what I have and that an education is what I must pursue to accomplish my goals and dreams. With all the love and support of my family and friends I have a great positive outlook on a college education. Having moved on to this next step in my life, I already feel as if I’m that much closer to reaching my goals. I can see how proud my family is as they watch me better my life and future. With all my past experiences, I now have a strong mentality to finish with pride and follow all my dreams. Overall, an education is the way to success and the key to many great opportunities.

Financial Environment Essay

Introduction With recent big changes in healthcare legislation, health care organizations are moving towards a system that changes reimbursement procedures. Health care organizations will be reimbursed by the government based on the quality of care provided by that organization. The Affordable Care Act (ACA) requires certain steps to make Medicare more resourceful by decreasing the amount of overpaid funds to insurance companies, adjusting reimbursement rates to levels that are more suitable, and altering payment scales and systems to support the delivery of efficient, premium health care (â€Å"Centers For Medicare & Medicaid Services†, 2013). There are several different types of health care organizations that offer medical services to patients. Because of the many different services and organizations in healthcare, the financial aspect of health care is not so cut and dry. Health care organizations can be described as either for-profit, not-for-profit, or part of a government organization. Some examples of these health care organizations are hospitals, nursing homes, health insurance companies, and home health care agencies. Gapenski (2008) explains that he healthcare field is different from any other field mainly because of two factors. Unlike other types of services, most healthcare providers and organizations are structured as not-for-profit rather than being owned by an investor. Another major factor that contributes to its uniqueness is the fact that payment is made by a third party rather than the individual who receives the services. For-profit Organizations The Watermark at Logan Square, Tenet Healthcare, and Hospital Management Associates (HMA) are just three examples of for-profit health care organizations in today’s market. These are investor owned organizations that must pay taxes and do not receive the same benefits that not-for-profit organizations receive. For-profit healthcare organizations are owned by investors. In terms, this means they have shareholders who benefit directly from any profits that are generated from this organization. Unlike, not-for-profit organizations, these for-profit organizations do not usually have the mission of taking on charity work or cases. Not-for-profit Organizations Not-for-profit hospitals are nongovernment entities that are organized with the main goal of providing inpatient healthcare services. Three examples of not-for-profit healthcare organizations include The Hospital of the University of Pennsylvania (HUP), Memorial Sloan-Kettering Cancer Center, and The Cleveland Clinic. Gapenski (2008) explains that not-for-profit organizations must be structured and managed so that they operate exclusively to the interest of the public. Non-profit organizations were formed with the purpose of servicing the needs of the less fortunate. This later led to non-for-profit hospitals being free from paying taxes because of the fact that they were providing certain social services. Due to the fact that individuals can not benefit from the profits of not-for-profit organizations, dividends from these organizations cannot be paid (Gapenski, 2008). Not-for-profit organizations are also controlled by a board of trustees, which often times makes it hard to make certain changes or decisions without everyone in agreement. Because of the current economy, Ebrahim (2010) explains that not-for-profit organizations stand out more in the area of public policy and the delivery of public services than they have ever before. Currently, the existing economic crisis has caused cuts in funding at both the state and local level. These financial cuts often times force many not-for-profit organizations to reduce the services offered. Obtaining funding with these setbacks is a major challenge for any nonprofit organization. When these organizations are not getting the funds they were once given, it takes a lot of budget restructure to not be incomplete deficit. It is still important  for these organizations to gain some type of profit to be able to purchase more equipment, technology, or even land to help provide quality care. For-profit vs. Not-for-profit Both for-profit and not-for-profit hospitals produce revenues through their daily operations and interactions. Unlike not-for-profit hospitals, for-profit hospitals are able to generate funds by issuing stocks. On the other hand, not-for-profit hospitals can accept tax-deductible contributions. The two different types of organizations generally have different ways of handling decisions regarding different financial and capital investments. A not-for-profit organization does not have the same opportunities for the capital structure that a for-profit organization does. In particular, a not-for-profit organization cannot sell new shares or ownership interests. Governmental Organizations Government organizations, like not-for-profit organizations, have no stockholders who receive the remaining assets when they are liquefied. Government health care organizations offer care to patients at a certain cost or agreed fee. The patient is responsible for a certain amount and the insurance is responsible for the remainder of the bill (Berger, 2008). Conclusion Healthcare finance is not always easy to grasp. It is important that one has a general understanding of how finances are managed in healthcare. It is essential for one to understand the differences in the types of organizations and it may help understand why certain decisions are made. It is also beneficial for one to stay updated on legislation in healthcare because it may directly shape the way that finances are handled. References Berger, S. (2008). Does God Exist Essay

In this busy world where almost everything is explained by Science and evidence, no one seems to bother questioning the existence of God. They are either apathetic or simply decided to be atheists or agnostics. Many people, especially the youth, are apathetic. They would rather preoccupy themselves with the newest game of Playstation 3, Hollywood blockbuster movies, sexy music videos of Paris Hilton, sports car, and other more exciting things. Topics of religion and faith are none of their businesses for these are the problems of the priests, pastors, and other faith defenders. They believe that they are too young to care and the important thing is that they do belong to a certain religion, attend some religious obligations, and those would be enough and will serve as â€Å"tickets† to their salvation. But do they understand what they are doing? Do they know what God they are worshipping to? Do they really reflect if they really want the religion they’re into, or they just go with the flow? Others would simply negate that there is a God. These are the atheists. They do not believe in a Supreme Being who creates and controls everything simply because they do not want to. Then, there are those who play safe, the agnostics. They do not confirm nor deny the existence of God just because no one can prove both arguments. Another belief is that of Scientology. Their stand is the only things that are true in this world are those, which can be explained by Science and supported by evidences. Obviously, they do not have a God. The question now is what do we get with these different views. What happens if we believe in God or not? Are we free from the sufferings of this world if we chose to believe in Him? The answer is no. Mr.  Tom Cruise, who is in Scientology, seems to get all the luck in the world even if he does not believe in God. Mother Theresa of Calcutta, who devoted her life caring for the unfortunate, suffered and died as a poor nun. Has she changed the lives of the poor she took cared of? No. The Philippines, a Catholic country, belongs to the Third World where people die of hunger, experience heinous crimes, and suffer from poverty. On the other hand, parts of Europe and United States, where religion and faith seem to be buried under material aspirations, are among the 1st World countries. Ironically, those who have deep faith are the ones who bear all the cruelties in this world, while those who do not have been quite lucky. How unfair life is, isn’t it? But our religious leaders are ready for their standard answers – â€Å"Better suffer here on earth! The more you suffer, the greater the reward awaiting for you in your after life! † So, let’s all suffer despite our goodness. Isn’t it logical? One day a child asked me if there’s a God and I said yes. Then, she asked again why could not she see Him? I couldn’t simply tell her to close her eyes, just have faith, and believe for this won’t answer her question. I couldn’t just tell her that I have Master Yoda’s â€Å"Force† with me and she should believe it. I have to show it to her and let her feel it. I have to give her something that she would understand. It was not the atheists or agnostics, who are closed to the fact that God exists I had to convince, it was a curious girl wanting to know God’s existence. I have to give her a logical explanation for all of these. St. Thomas Aquinas offered 5 reasonable ways to prove God’s existence. First, he believes that there has to be an â€Å"Unmoved Mover. † At this point, I picked up a stone and threw it away. Then, I asked the girl if who made the stone moved. She eagerly replied, â€Å"You! † I said she was very smart. Then I asked her again who moved me to pick up the stone and threw it. She replied, â€Å"God? † The first argument of St. Thomas has 3 basic facts – one, that nothing can move itself; two, if an object is dependent on another in order for it to move, then the first object in motion also needed a mover; and three, the first mover should be unmoved, and this could be God. Tired of walking, we sat on a wooden bench. I asked the girl if she knew the maker of that beautiful bench, the replied she made was it’s the carpenter. I then asked her if she had an idea who made the carpenter. She frowned and whispered, â€Å"his parents? † Again, I asked her who made the carpenter’s parents’ ancestors? Isn’t it God? St. Aquinas’ second way is the causation of existence. He believes that there must have been an â€Å"Uncaused First Cause† who created everything and began the chain of existence. Related to this is St. Aquinas’ 3rd way or the â€Å"contingent and necessary beings. A bench is a contingent being made by wood that came from a tree; man planted that, and who was created by whom? There must be something/someone at the end who created all contingents. St. Thomas Aquinas believes that every contingent being should be dependent form a necessary being for them to exist and that there must exist a being which is necessary to cause contingent beings – this could be God. The small girl looked perplexed with all of the explanations I was giving her. I diverted her attention by asking him to compare Mr. Brad Pitt and Mr. Tom Cruise, of which of the two were more handsome. She immediately replied, â€Å"Brad Pitt! † I then told her that even if Mr. Pitt has a slight edge over Mr. Cruise, there has to be someone more handsome than Pitt or this may even be the most handsome of all handsome. This is the gradient of beauty or perfection. One has to be compared to another that may have more or less. And this is the 4th way of St. Thomas, the â€Å"argument from degrees of perfection. † He believes that there are grades or degrees of perfection and that there must be a perfect standard by which all qualities are measured and compared with, this could be God. While resting, I asked her if she has been taught in her school about the different human systems, i. e. circulatory, nervous, digestive, and others. She said no. I asked then how about symbiotic relationships, photosynthesis, and formation of clouds, which she again had no knowledge in. But she said that she knew where the food goes after it was eaten. Then, I asked her if she was not perplexed by how systematic nature works. It is easier to accept that there must be an â€Å"Intelligent Engineer† who planned all of these rather than these were all products of a big explosion. St. Thomas last way talks about an â€Å"Intelligent Designer†, someone or something must have done these, and this could be God. I am not sure if all of my explanations were enough for the girl to believe in God, but what I have presented, based on St. Aquinas’ 5 Ways, were all basics in life. We experience them daily. These are evidences just enough to convince ourselves that someone or something must be in control, caused things, and moved things. This someone may be the creator of everything, including love, happiness, pain, and suffering. These logical evidences may be still absorbed by a child, but not for atheists. Non-believers would argue that, granting there is a God, who is all-powerful, all good, and all knowing, why does he let certain things happen. Why does he let the plane with a suicide bomber inside to land in the World Trade Center killing a lot of innocent people? If Superman, a fictional character, can stop a plane from crashing, so why cannot this Someone who is omnipotent? If this Someone is all good, why can he let this happen? If he’s all-knowing, then he knew that it was bound to happen and he didn’t do anything to prevent it. I cannot personally provide an answer to all of these doubts that are sufficient for them to believe. But what I do believe is that maybe, crimes like this, were part of the â€Å"master plan† of the Intelligent Designer. † Maybe, what is â€Å"perfect† for him is different from our own concept here on earth. Every abstract painting must look chaotic and one cannot figure it out easily. But when you see its meaning, you begin to appreciate and treat it as an art. Maybe, this is really what life should be. Probably, the beauty of life includes sufferings, cruelties, chaos, and other unacceptable facts. Relative to why God allowed such crime to happen, I believe that He is just respecting the law of nature. He created man to be intelligent and free, thus, he has all the freedom to do whatever he wants to. But of course, in every action there is a consequence, and man should face that. If he decided to eat more then he’ll have himself full and a possibility of stomach ache. The same goes with killing. If one wants to take others lives into his own hands then he can. But this act does not differentiate man from animals or other lower beings. An additional feature was given by the Intelligent Designer exclusive to man, which is conscience. After we knew the rightness or wrongness of an act, we have this conscience if we feel we have done something wrong. That’s the way it is, that’s human nature. And God respects it. God does not want the plane to crash, the suicide bomber wanted it. God, maybe, allowed it for He has a greater plan and there’s something good coming from that crime. The crash was terrible, people died, but it made Americans pray hard at least for a day. It caused them to unite to fight against terrorism. It caused them their humility that they do not control their lives even though their powerful. Proving God’s existence is almost impossible if you’re convincing an atheist or an agnostic. But it is not our duties to force others to believe in each of our own faiths. There are so much complexities in a religion, whether its Catholic, Moslem, Scientology, or even Atheists. Perpetual debates are heard daily claiming that their religion is the legitimate one, often times causing a fight between its pastors. But we tend to forget the basic and primal fact of being a human, which is to cause harmony to all mankind. Being human is to show love, respect, and service to everyone. I think in the end, when we face our Creator, religion would not be our only pass to salvation, but on how many lives we inspired and changed for the betterment of the world. Aren’t we tired of proving God’s existence? People spend a lot of time and resources looking for evidences of His existence just to correlate Science and Faith. Yes, there are unexplainable things such as violence, crimes, cruelties, and other unfairness of this world, that cast doubts to His existence, but we still manage to live. There is still air to breathe, food to eat, and water to drink. We don’t need a grand miracle of dead people rising to life and water turning into wine. Miracles happen daily from the moment we wake up and live for another day. It is not God who should prove His existence to us because it is obvious thru the wonders of this world. It is we, man, who should prove our existence to Him. Let us prove to Him that despite the materialistic and busy world we live in, human goodness still exists.

How to be Succeed in the first Job Essay Example | Topics and Well Written Essays - 1500 words

How to be Succeed in the first Job - Essay Example If a person has enough information about a place, he or she is likely to get used to the area quickly compared to someone who does not have any idea about the workplace. This kind of information can be accessed from the employer or other employees working at the place. This is commonly referred to as organizational learning (Kleynhans, 36). A new employee should actively interact with different employees so as to be in a position to gain knowledge about the new job. In most cases, people learn from other workers in the organization and this is very effective in as far as knowledge creation is concerned, hence the need for a new employee to interact with older employees in the company. It is also very important to conduct personal research about a workplace in order to be in a position to succeed in the first job. It is essential for a person to show that he has some knowledge about the job as well as the workplace when he joins the company. This helps to reduce the chances of confusi on when one is working in a certain company. Personal researches can be conducted using different strategies. The internet for instance is very effective in as far as searching for information about any particular subject is concerned (Hyder). For instance, Google search engine is very effective in as far as research about a specific area or place is concerned. Different companies now have their own websites and these are very effective since any information about a given subject can be accessed. Information related to the type of work performed can also be accessed from the internet. Individual career development is also essential in order for a person to succeed in the first job. Robbins (570) states that it is very important for a prospective employee to first assess his or her skills since the idea is to capitalise on your strengths. The other important aspect for the prospective employee is to merge what he or she likes with what he or she can do best. It becomes easier for the new employee to be a great achiever since he has the knowledge to perform different tasks in the new job. On the other hand, it can be observed that the concept of safety management has significantly gained prominence during the contemporary period. Safety management is a discipline that requires the new employee to acquire vital knowledge from the people who are experienced in the same type of work. The experienced workers can impart their vital knowledge to new workers and this can also help to ensure their safety. During the current period, it can be seen that organizations are more concerned with ensuring that employees are working in a safe environment. For instance, in mining, construction or any other manufacturing industry, it can be seen that safety management is given the priority it deserves. Companies provide booklets that have information about the safety procedures that can be taken during the period they are performing their job. Each department also has a supervisor who will be concerned with ensuring that all the new employees have understood the demands of their work. This also helps them to minimise chances of getting injured at the workplace since they will have the right knowledge about safety at the workplace. When one is visiting a construction site in a building

Evaporator Mass and Energy Balance, and Mechanical Design Essay

Evaporator Mass and Energy Balance, and Mechanical Design - Essay Example As the discussion outlines that evaporation is a plant operation used to concentrate a solution or a liquid of a nonvolatile solute and a volatile solvent, which many at times we use water. A portion of the solvent is vaporized to produce three products i.e. concentrated solution, slurry or thick and viscous liquid. Evaporation can be confused with drying but it differs from drying in that the residue is a flowing liquid instead of a sticky solid material. Evaporation on the other hand is different from distillation in that there is no deliberate attempt to separate the vapors into individual components. This essay highlights that evaporation is one of the most energy consuming processes within most industries including dairy, food and chemical industries, it is most essential that evaporation be approached in regard to economical energy utilization and effectiveness of the process. In addition, evaporator should be safe to operate and offer no negative environmental impact. It is pos sible to achieve the above when equipment manufacturer is able to offer a full selection of evaporation technology and systems developed to accommodate various product characteristics, the percent of concentration required, and regional energy costs.  Achieving control of most chemical/industrial evaporator systems is quite simple. However, with hygienic evaporators the control is somewhat more complicated due to the need to start up, operate, shut down and then clean at quite frequent intervals.... per P&ID Piping and Instrumentation Diagram PHA Preliminary Hazard Analysis PLC Programmable Logic Controller MP Main Product PNCB P-Nitro Chloro Benzene DFC Direct fixed cost Table of figures Figure 1: Multiple effect evaporation with thermo-compression Figure 2: Simplified flow diagram of Evaporator of pharmaceutical plant Figure 3: Relationship between evaporation ratio (e) and concentrations of Feed (Products) and concentrate (GEA 2012). Indians and Indian Policy Essay Example | Topics and Well Written Essays - 1000 words

Indians and Indian Policy - Essay Example Vince Deloria in his narrative highlights the issues of leadership and preservation of the Indian culture. Vince Deloria was a well known professor, leader and advocate for the Indian rights and cultural recognition. Deloria was a Standing Rock Sioux and he experienced firsthand the effect of government policies on the lives of native Indians. He wrote his narrative during his period as a professor and advocate of the native Indian rights. In the period between 1970 and 80, the Indian population experienced tremendous population growth that was not understood. Immediately after the Second World War, the Indian people were given opportunities to be economically empowered through the Indian Re-organization Act. However, this did not endear other races and people to identify with the Indian race since other people enjoyed better services and economic benefits. During this period Indians felt no sense of personal worth in propagating their culture or sense of identity (Calloway 567). Del oria however explains that this trend started to change in the 1980’s when people wanted to be recognized as Indians whether it was to gain educational or economical benefits. But this was the reason that endeared other races to becoming whites but it was the religious practice of the native Indians that made many white people to associate with the Indian culture. ... However, Deloria delivers the message that native Indians can only solve their problems through use of the culture since they understand their problems better than other people. Native Indians have suffered the problem of genuine leadership which contributed to Indian discrimination. As a result, it is a high time for Indians to recall their culture and chase away imposters who do not understand Indian culture or problems as advocated by Deloria (Calloway, p.571). On the other hand, Wilma Mankiller was the first woman Cherokee chief narrates her experiences as the chief of a native Indian tribe. In her story she highlights the challenges that the Cherokee people faced in living their lives normally in a country they were considered as minority ethnic group. Her early life prepared her for the role she was to engage in as a political leader among the Cherokee people. The lacklustre governmental policies gave her motivation to campaign and fight for the recognition of native Indian rig hts. Wilma wrote her stories so that she could share with future native Indians her story especially to the Indian women. Wilma wrote her narrative during a period when native Indians were enjoying recognition from other people especially the majority white population in the US (Calloway 573). It was during this period that Indian tribes were given the opportunity to choose their own leaders who could manage their own affairs. The change in government policy and the new policy changes that recognized Indians gave an opportunity for Indian tribes to govern their own affairs. Moreover, Indians were now educated and were better placed to manage their own affairs as elucidated by Wilma. The narrative told by Wilma is in fact true based on the real events that occurred

Adoption of International Financial Reporting Standards (IFRS) in Term Paper

Adoption of International Financial Reporting Standards (IFRS) in European Union - Term Paper Example According to the paper findings the adoption of IFRS in European Union constituted one of the biggest financial reporting alterations in current years and was debatable. The adoption of IFRS results in the use of a universal set of financial coverage standards within Europe, and between Europe and many other countries that require or apply IFRS. This essay declares that the impact created by conversion to IFRS was much bigger and broader than expected. The EU experience states that it affects many areas beyond finance and includes human resources, business operations, IT, customers and external stakeholders. Furthermore, it can be learnt from the EU conversion that IFRS switchover will add considerable intricacy to a range of openings which firms currently pursue. These are mergers or acquisitions, expansion of global operations and new enterprise information systems implementation. IFRS renders companies with a major opening to attain broader transformational change and motor business gains beyond compliance. The economic arguments for the adoption of IFRS are that it is being viewed by many as having very good quality and is sufficient for the task. Indeed there is some empirical research evidence which supports the belief that same standards of financial reporting globally will surely increase market liquidity, reduce tra nsaction costs for capitalists, lessen cost of capital and finally facilitate international capital formation and flows.

Mental Health review tribunals Essay Example | Topics and Well Written Essays - 3500 words

Mental Health review tribunals - Essay Example To ensure the protection from the evils of such disorder world legal forum set mental health tribunals to justify human rights for all irrespective of gender, race, territory and mental condition. From perspectives of the discipline of positive psychology, mental health may include an individual's ability to enjoy life and procure a balance between life activities and efforts to achieve psychological resilience. Subject to the Conditions as an introduction to the Mental Health Act, and as a suggestive source for people with mental health needs, professional workers and others encounter with these Acts. The Mental Health Act 1983 governs the admission of people to psychiatric hospital against their will, their rights while detained, discharge from hospital, and aftercare in England and Wales. Aprt from the philanthropic attitude there is criticism that the Act itself is not well organized, which is written in language that can be hard to follow for certain complications of the descrip tion of the legitimate proposition. The Domestic Violence, Crime and Victims Act 2004, which received Royal Assent in November 2004, contains a number of measures to extend the Government's program of improving services and support to victims of certain criminal offences from prison to hospital for psychiatric treatment, as well as offenders subject to hospital orders with restriction orders. Custodial remand remains ironic when convicted of a sexual or violent offence are then made subject of a hospital order as found unfit to plead and to have committed the act, and been charged, or not guilty because of insanity. They direct the admission to hospital of patients transferred from prison, and consider recommendations from Responsible Medical Officers in hospitals for leave, transfer or discharge of restricted patients. MHU also prepare documentation for Mental Health Review Tribunals (MHRTs), and monitor patients. For each new case, including transferred prisoners, the Victim Liais on Officer (VLO) do contact the MHU caseworker. Imperial evidences furnished through Mental Health Review Tribunals say a detained restricted patient may apply to have their cases heard by a MHRT once each year. If the patient does not apply, the Home Secretary would refer their case to a Tribunal every three years. The Tribunal will consider whether the individual needs to be detained in hospital for the purposes of mental health treatment. Liason officers should consult victims about their representations relating to discharge conditions and forward them to the Tribunal Office by the specified date. The document state that victims should be made aware that no guarantees can be given that any representations they make will not be disclosed to the patient. In fact, the expectation is that all documents are disclosed to the patient and the circumstances in which documents can be withheld are very limited. Rule 12 of the Mental Health Review Tribunal Rules 1983 allows the Tribunal to withhold any document from the patient if they co nsider that disclosure would adversely affect the health or welfare of the patient or

Item Analysis and Marks Assignment Example | Topics and Well Written Essays - 500 words

Item Analysis and Marks - Assignment Example The two item analysis procedures are beneficial to learning and assessment because they help improve the quality of an exam by identifying items that prepare candidates for retention, revision or removal. Item analysis identifies both good and deficient items and clarifies concepts that the examinees have not mastered (Kubiszyn & Borich, 2010). The risks that come if these items are not administered are that the wrong impression will be got of the student that is not true. Students may fail because there were errors that gave rise to multiple interpretations and not that they did not know. An example of imperfect test may be for example: who was the President of America between 2000 and 2008? A second one may be: Assess the importance of not examining students after end of the course. It is important for the teacher to use both qualitative item analysis and quantitative item analysis because they help to fine tune a test and build reliability and credibility into a test. When we look at qualitative analysis we find that it is subjective as opposed to quantitative analysis and therefore a combination is important to eliminate errors and build credibility into the test (J., 2009). The authors say that marks reflect only academic achievement and not other factors like attitude and effort because of many reasons. One is that factors like attitudes and effort cannot be graded in terms of marks and therefore it would be difficult to rate a student at the end of the learning period. Secondly students come to school to gain knowledge in a specific field and they are subjected to a syllabus and content that thy must cover in order to show their understanding of various aspects of the course. Their understanding of the knowledge covered in the syllabus can only be done by giving them a test to using marks to gauge their achievement (Kubiszyn & Borich, 2010). Unfortunately attitudes and efforts do not compose the content of the syllabus

Which is and will be the most powerful institution guiding human Essay

Which is and will be the most powerful institution guiding human activity in the next century... the state... the market ... or NGOS and IGOS - Essay Example Why is this so? First, most issues will have continued to be supra-national in nature to which the state is inherently constricted by its territorial boundaries. Hence, there is the increasing need for global governance (UBUNTU Foundation 94). As such, this makes IGOs most in demand, because the very supra-national nature of IGOs enables them to transcend the limitations of the state, while allowing them to act just like the state. In short, IGOs can govern globally. Where the state cannot intervene into the peace and security problem of a neighboring state, IGOs can. As defined, IGOs are created through a constitutive treaty involving two or more nations that come together in good faith for a common issue of interest. They are meant to create a mechanism through which nations of the world could work collaboratively more successfully concerning peace and security, economic and social issues. (Koteen, par. 1-2) Thus unlike NGOs, IGOs, Pease explains, have international legal personali ty. Meaning, IGOs are authorized to act under international law. For example, they can enter into international agreements with other international organizations and states; they can file a case in national courts; and they are also given immunities similar to the state. (6-7) Therefore, IGOs can be as powerful as the state in a much broader framework. Second, the unregulated dominant position of the market in the world economy, as manifested by the pervading powers of transnational and multinational corporations, is perceived not only to have increasingly threatened the sovereignty of nations but also to have caused poverty and to have widened inequality as it polarizes the world between the rich North and the poor South (Lodge and Wilson 9), which to many are enough reasons for violent conflicts to further intensify and for rebellion and terrorism to be justified. Though it may be argued that poverty is not the main cause of terrorism, Von Hippel sustains that there exists a signi ficant relationship between economic vulnerability and radicalism and terrorism (52-53). Suffice it to say therefore that the market, given its greed for profit, tends to exacerbate rather than mitigate violence and insecurity. Given this negative perception of the market, the need for global governance to regulate the market in order to lessen its impact on global economic inequality, consequently lessening possible sources of global insecurity, will become a necessity. Hence, the IGOs will become more influential. In fact, history shows the consistent trend that every after major world conflicts (i.e., Russo-Japanese War, World War I, and World War II), the emergence of IGOs for peace and security sharply increases (Jordan 18). Since the threats of world conflicts, though may no longer be in the form of world war, remains; the necessity for IGOs stands. Third, IGOs have consistently shown their effectiveness not only in finding ways to help resolve interstate conflicts but even in helping nation-state deal with its intractable conflicts (Brahm, par. 1). Hence, the prime usefulness of IGOs rests on their capability to provide states with a forum through which they can sit down and resolve their conflicts – Something that the market and the nation-state have not shown to be capable of. This cited effectiveness of IGOs could be attributed to the very purpose of their creation, which Brahm

Home School vs. Public School Essay Example for Free

Home School vs. Public School Essay I prefer home schooling over public schooling; which one do you prefer? There are both pros and cons for both Home Schooling and Public Schooling. I am going to explain this all to you in my essay. I personally was home schooled for a few years during middle and high school. All of elementary school and part of middle school I went to a regular school. My reasoning for choosing to be home schooled is I have Agoraphobia which is an anxiety disorder caused by situations where people perceive the environment as being difficult to escape or get help. As soon as I would walk into a class room I would have a panic attack. One thing I liked about public school was being able to play volleyball. I loved playing it for the little bit of time that I was in middle school. Even though I wasn’t really all that great, So I didn’t play very much. That is one con of being home schooled. You cannot play sports affiliated with any school. A pro for public schooling is you have a group environment to learn in with others to help you. On the other hand with home schooling you are on your own. In home schooling you have less choices of curriculum as you would if you were going to public school. You also have more diversity in public school. When going to public school you have a higher student to teacher ratio, now with home schooling there is a small teacher to student ratio. In home schooling you are free to choose your schedule, as in public school your schedule is strict and chosen for you. Public school chooses the curriculum for you. Unlike in home schooling you can choose your own. There are now roughly millions of children being home schooled. Being home schooled teaches students to be independent in their learning choices. Sometimes home schooling can be more expensive than going to public school. Teachers are not always qualified to teach all subjects, and colleges sometimes have stricter admission policies concerning home schooled students. It is also harder to provide social interaction when being home schooled. Like I had stated before I prefer home schooling but everyone has their own opinions. This is the reason why I have enrolled myself into the University of Phoenix online. So that I can have the flexibility of my classes, this way I can work around my everyday life and not miss out when it comes to spending time with my boys. I hope that the information in my essay was helpful to you.

Five Forces of Competition Essay Example for Free

Five Forces of Competition Essay Air travel has changed the way people live and experience the world today. The airline industry is a strategic sector that plays a fundamental role in the globalization of other industries since it promotes tourism, world trade, foreign investment and, therefore, leads to economic growth. However, all airlines within the industry operate in a highly dynamic environment where various legal, social, technological and economic forces interact with each other, thus influencing their decisions and actions In the industry where airlines can face severe financial distress due to oil crisis, recessions and terrorist attacks, In order to survive, as well as succeed, the business needs to assess its competitive environment and identify key factors that may influence its actions (Porter, 1998, p. 5). The airline industry is very competitive and Michael Porter’s five-forces model can be used to analyse the intensity of the competition and the profitability of this industry. Porter’s five forces model is a business unit strategy tool which is used to make an analysis of the value of an industry structure (Hubbard, 2004, pg 35). The analysis is made by the identification of 5 fundamental competitive forces. These include: Threat of new entrants is high  One of the forces identified by this model is the threat of new entrants which refers to the possibility of new competitors entering the industry and undermining the profits of the established businesses. In the world today, the airline industry is so saturated that there is hardly space for a newcomer to enter the market. The biggest for this is the cost of entry. The airline industry is one of the most expensive industries, due to the cost of buying and leasing aircrafts, safety and security measures, customer service and manpower. Other barriers to entry which will recess new comers into the airline industry include Government restrictions and high capital costs to develop new airlines. However, the entry barriers for new airlines is lower today since the Australian domestic airline market was deregulated in 1990. This has produced far greater competition than before deregulation in most markets. The deregulation has allowed Jetstar and Tiger Airways enter the market and reduce the market share for Virgin Blue and with the added competition, together with pricing freedom, means that there is a major onstraint on profitability for the airline industry. Moreover if borrowing is cheap the likelihood of more airlines entering the industry is higher. Bargaining power of Buyers is high The bargaining power of buyers is another force that can affect the competitive position of a company (Porter, 1998, p. 48). This refers to the amount of pressure customers can place on a business, thus, affecting its prices, volume and profit potential (Porter, 1998, p. 45). The various airlines flying from the Gold Coast airport are competing for the same customer, which also results in strengthening the buyer power. Individuals wishing to travel to and from the Coolangatta airport are presented with various choices when selecting an airline but price is usually the most important factor, especially for students and families. Hence, the bargaining power of customers in the airline industry is very high since they are price sensitive and search for the best deals available. Virgin Blue attracts travellers that are price sensitive by offering them low fares and those that are convenience oriented by providing them with frequent flights. Qantas on the other hand has created a frequent flyer program to create switching costs which may be a significant factor to a traveller when choosing which airline to fly with. Bargaining Power of Suppliers is high Suppliers can also exercise considerable pressure on a company by increasing prices or lowering the quality of products offered which are mainly dominated by Boeing and Airbus. The bargaining power of suppliers depends on supplier concentration, substitute supplies, switching costs, threat of forward integration and buyer information. However, other suppliers who work with the airline such as the providers of on board snacks do not have the same bargaining power as they are a larger industry which allows for Virgin Blue to have a choice over who they are purchasing from. Virgin Blue will purchase their on board snacks from the supplier which is the most economic so Virgin Blue can make a higher profit margin from the goods when they are sold. Threat of Substitutes is low for international carriers/ little higher for short distance The availability and threat of substitutes is another factor that can affect competition within the airline industry. It refers to the likelihood that customers may switch to another product or service that performs similar functions (Stahl, M, Grigsby D 1997, pg 145). Substitutes for air travel include travelling by train, bus or car to the desired destination. The degree of this threat depends on various factors such as money, convenience, time and personal preference of travellers. The competition from substitutes is affected by the ease of with which buyers can change over to a substitute. A key consideration is usually the buyers switching costs, however due to their low fare non-stop flights, Virgin Blue, Jetstar and Tiger airways can lure both price sensitive and convenience oriented travellers away from these substitutes. Competitive Rivalry is high  Industries that are very competitive generally earn low profits and returns since the cost of competition is high. The airline industry is usually characterized by the cut-throat competition that exists among the rival airlines due to its low cost nature. Since the carriers are involved in a constant struggle to take away the market share from each other, industry growth is average and as it is easy for buyers to switch between the airline companies, depending on price, the rivalry is increased. Rivalry is also high in the airline industry due to high fixed costs, as much of the cost of a flight is fixed, there is a great opportunity for airlines to sell unsold seats cheaply, which resolve in pricing wars between the airlines (Hubbard, 2004, pg 38). The airlines are continually competing against each other in terms of prices, technology, in-flight entertainment, customer services and many more areas. The net result of this competition between companies is an overall slow market growth rate. In conclusion we can understand that the airline industry is very competitive and Michael Porters five-forces model can be used to explain why the potential for returns is so low in this industry. Firstly, the threat of new companies entering the industry is high and the entry barriers are low. Secondly, the bargaining power of customers is high since they are price sensitive and search for the best deals. The third force, bargaining position of suppliers, is strong since they are concentrated and this limits the control airlines have over suppliers to reduce prices and earn higher profits. The availability and threat of substitutes is another factor that can affect a company’s competitive position. However, the degree of this threat depends on various factors such as time, money, convenience and personal preferences of travellers. The final force in Porters model is competitive rivalry between the companies within an industry. Cut-throat competition exists among the airlines and since there is a constant struggle for market share, the over all profit potential of this industry is low.

Academic Culture In Different Countries

Academic Culture In Different Countries Academic culture refers to the attitudes, values and ways of behaving that are shared by people who work or study in universities, for example, lecturers, researchers and students. (Brick, J, 2009, p.2) What constitutes academic culture is different for students who come from different cultural backgrounds? The academic culture is totally different for Malaysia and Australia. In Malaysia education, the teaching styles is more teacher-centered where teachers will be giving exactly all the information to students and students are not expected for give respond to teachers questions. It is called spoon-feeding learning styles in Malaysia. This learning style is very popular in Malaysia education because it makes the learning easier to students. Therefore, students dont need to find any extra information for their studies. However, the teaching styles for Australia education is based on student-centered. Australian students are expected to play an active role during tutorial. Students need to have an active participation in discussion with their peers. Besides, students are able to challenge to lecturer or tutor because they can express their opinion. In Malaysia, the education system is more exam-oriented. Therefore, spoon-feeding learning styles will make students only study for specific books or the notes that they get from teachers. Other than that, students will follow the instruction that given by teachers which is memorizing the notes and go for examination. In this approach, students dont understand the knowledge they learned. So, they cant become an active learner in the future. Conversely, Australian education system is more practical-oriented. They are focusing on student understanding. It is not just study everything without understanding the knowledge. Students are advised to voice out their opinion during discussion. It is a training program for them to become independent learners in the future. MCD 1510 Learning Studies (Task 2) Culture is an integral part of society. An individuals attitudes, values, beliefs, arts, ideals, modes of perception, and habits of thought are greatly influenced by the culture in which he or she lives. Every society has a different culture, where people who share their culture also share their attitudes, specific languages, behaviors, values, and traditions. It is easy to know the culture background for a person based on their attitudes and behaviors. For example, the common perception of Australians is that they are informal, open and direct and say what they mean. They call people by their first name and say please and thank you to be polite. They are allowed to call teachers by their first name, even though they are students. This showed that they believe that people should be treated in the same way and the principle of giving people a fair go. Conversely, most Chinese has a very formal culture when they talk to someone who has a higher status and older than themselves. They place their culture importance on hierarchy. They need to show their respect when talk to older people and people who has a higher status. Therefore, they call a persons whole name which is his or her first and last name together. Other than that, Chinese has a lot of etiquettes during meeting, gift giving and dinning. Besides, greetings are formal and important and the oldest person must be always greeted first. However, culture is not only about the different culture countries background. There is a culture named academic culture which is the culture of universities. Academic culture refers to the attitudes, values and ways of behaving that are shared by people who work or study in universities, for example, lecturers, researchers and students. New students have to learn new knowledge, new skills and new attitudes, values and ways of behaving; that is, they have to learn a new academic culture. Therefore, academic culture is unfamiliar to many students who come from different countries background. English-speaking universities are the universities who have used the language of English as an instruction. However, it is not necessary that those universities are sharing the same academic culture although they are teaching in English. One of the ideas for academic culture is there is more than one way to approach a problem. Scholars tried to find the most useful answer when they are approaches to a problem in different ways. Each scholar presents their ideas in the way that he or she does agree with and criticizes ideas that he or she does not agree with. This shown that there are many scholars in English-speaking universities believe academic knowledge develops. *dont understand the describe how many scholars in English-speaking universities believe academic knowledge develops. MCD 1510 Learning Studies (Task 3) Academic writing is a particular style of formal and expressive writing. In this form of writing, it should be third person, formally toned writing and precise words. Text 4 is another extract from an article on deforestation. There are several ways to show that this text is a piece of academic article. The purpose of Text 4 is to explain what happen after deforestation, so its tone is logical, rational and impersonal. It is logical because it outlines the happen after deforestation, so the reader can see the reasoning. Besides, it is rational because the article is based on evidence and research. It is important to use evidence and reasons in academic writing, because it shows whether the research is based on support or not support. Therefore, there is supporting arguments and facts for this article which the reader can check it. It is impersonal, because it is based on verifiable evidence not personal feelings. It is objective writing because the article is written in third person not first person. Other than that, it is a formal writing style because there is no slang, no abbreviation and complete sentences. Based on the referencing, it is an authoritative website by government. This means that it is the website which reader can trust the argument and facts for the article. There are one more features of academic arguments can be identified. An academic article has the strength and logical order of arguments. The information should be giving verifiable to support the discussion when writing an academic article. Besides, this article is using formal words for the writing. MCD 1510 Learning Studies (Task 4) There are some major features of academic culture in University life. One of the major features of academic culture in University life is student voice should come through when writing academic work. This means that excessive cutting and pasting other peoples ideas is not encouraged. It is so called plagiarism when students are cutting and pasting other peoples ideas in their assignment. Besides, student arguments need to be well supported to make their arguments stronger and avoid plagiarism. Otherwise, students are also expected to get the main ideas in other argument and critically evaluate the merit of argument. Other than that, student arguments need to be logical and evidence based. This means you have to remain objectives or impartial. Therefore, there is supporting arguments and facts for this article which the reader can check it. After that, students are advised to engage in wide reading. It brings out multiple perspectives which are different opinion and have a range of arguments to support the point of view. This means that ideas are no black or white.

Comparisons of Art :: essays papers

Comparisons of Art In the Egyptian era there were many art forms that were done and sculpted. Seated Scribe is one of these Egyptians sculptures. It was done in 2400 B.C.E and was done in limestone by subtractive sculpting. The colors that are used in this sculpture are very plain and bland. You can notice that the color is wearing away at the sculpture because there are blotches where the paint has started to chip away. The sculpture is physically accurate of a middle-aged man because you can see the definition of the extra fat on his body and you can tell that he has some intelligence because of the way that he is presenting himself and that he is ready to write. The man is sitting on a square piece of stone and it seems as though he is about to jot a few notes down or write a letter. You can see that he is holding something that looks like a writing pad of some sort and you see his writing utensil in his left hand. The actual pose of the man is very stiff, very perfect. The Man is sitting w ith good posture and he does not let his back slouch one bit. It seems to be an uncomfortable position for the man. The artist wants us to see that the man in the pose is beginning to write a story about what he is observing. The man is sitting outside on a rather warm day and he is observing the Pharaoh and how he is treating his people. The man is about to take some notes so that his mind will not draw a blank when he goes to writing the actual story about the Pharaoh. The man is very intelligent and very wise. People come to him when they need advice or answers to a problem. He is trusted by all because he is the writer that the Pharaoh trusts. The man is also admired by all because he is one of the few who can read and write. Many people did not have this type of advantage during these times. A more modern sculpture was done in 440 B.C.E by a Greek sculptor and it is entitled the Doryphorus Spear Bearer. The sculpture was also done with subtractive sculpting done in stone.

Lincoln Assassination :: essays research papers

he Lincoln Assassination On April, 14 1865 President Abraham Lincoln was shot while watching a performance of An American Cousin at Ford’s Theater. President Lincoln died the next morning. The person who had killed Lincoln was John Wilkes Booth. A few days before he was killed, Lincoln had told his spouse about a dream he had, he saw a president shrouded on a catafalque in the east room of the White House. Even after this dream he attended An American Cousin at Ford’s Theater. John Wilkes Booth thought the president was determined to destroy the constitution, set aside the rights reserved to the states, crush civil liberties, and restore monarchy. He saw the confederacy was the only means to of upholding the values of the founding fathers. He devoted much of late 1864 and early 1865 to a series of plots to abduct Lincoln and use his capture to nullify the Union’s war aims. Every scheme ending in frustration. After Lee had surrendered to the Army of the Potomac, in the second week of April, he saw that only the most desperate measures offered any hope of salvaging the Southern Cause. Shortly before he went into the theater, he stopped at tavern for a drink. While in the bar an acquaintance jokingly remarked that "he would never be as great as his father," Booth replied by saying "When I leave the stage, I will be the most talked about man in America." The Atlanta Campaign of 1864 In the spring of 1864, Gen. W. T. Sherman concentrated the Union armies of G. H. Thomas, J. B. McPherson, and J. M. Schofield around Chattanooga. On May 6 he began to move along the railroad from Chattanooga to Atlanta. Sherman had two objectives, one was to destroy the army of General J. E. Johnston and the other was to capture Atlanta. Johnston realizing that he was outnumbered started to retreat south. Sherman tried a direct assault on Johnston’s forces and was repulsed. Johnston had retreated back to the south bank of the Chattahoochee river. On July 17, John Bell Hood replaced Johnston as General. He tried to continue with Johnston’s plan, but failed to stop the advance of Union troops. He retired to Atlanta, which Sherman soon had under bombardment. On September 1 Hood abandoned Atlanta, the next day Sherman moved in and burned it. The Maryland Invasion A year after the confederate defeat at Gettysburg.

Analysis of Satans Speech in in John Miltons Paradise Lost

Analysis of Satan's Speech in Milton's Paradise Lost      Ã‚  Ã‚   John Milton's Paradise Lost is a work of enduring charm and value because of its theological conceptions, its beautiful language, and its "updating" of the epic to the modern world's values. Book II of this epic poem opens with Satan's speech to his minions in hell, proposing war on Heaven itself. In these first 44 lines, Satan is clearly established as epic hero, but at the same time is theologically/morally denounced by the speaker.    This section of the poem opens by establishing Satan's position of power and prestige:    High on a throne of royal state, which far Outshone the wealth of Ormus and of Ind, Or where the gorgeous East with richest hand Show'rs on her kings barbaric pearl and gold, Satan exalted sat, (II. 1-5).    These lines create an aura of awe and majesty for Satan, showing his glory and splendor through material things, while at the same time inferring indirectly that this material show is all that Satan has, rather than real power or value.    After this portrayal of Satan the epic hero in all his magnificence, the speaker (the heavenly muse) is very careful to bring down his image morally, despite the magnificent outward experience. The muse asserts that,    by merit raised To that bad eminence; and from despair Thus high uplifted beyond hope, aspires Beyond thus high, insatiate to pursue Vain war with Heav'n, and by success untaught His proud imaginations thus displayed, (II. 5-10).    The muse is very careful to remind the reader that Satan is in a high position because of his greed, and the high position he has obtained is not a good position t... ...son who uses elevated language well. The speaker's voice is brought forth showing that despite Satan's slick moves, he is the villain, but the reader still feels sympathy for Satan. The speech is a moving one, and certainly accomplishes the task of motivating the denizens of Hell to move against Heaven. It fits the framework of the poem perfectly, showing not only the theological goals of the poem, but also the desire of the poem to "mock" the traditional epic, and to provide a literary work of great beauty and power.    Sources    Fox, Robert C. Death penalty/capital punishment

It makes people think twice about their actions, instil fear evidence Michael Summers, PhD, MBA, Professor of Management Science at Pepperdine University, wrote in his Nov. 2, 2007 article â€Å"Capital Punishment Works† in the Wall Street Journal: â€Å"†¦ [O]ur recent research shows that each execution carried out is correlated with about 74 fewer murders the following year†¦ The study examined the relationship between the number of executions and the number of murders in the U. S. for the 26-year period from 1979 to 2004, using data from publicly available FBI sources†¦ There seems to be an obvious negative correlation in that when executions increase, murders decrease, and when executions decrease, murders increase†¦ Paul H. Rubin, PhD, Professor of Economics at Emory University â€Å"Recent research on the relationship between capital punishment and homicide has created a consensus among most economists who have studied the issue that capital punishment deters murder. Early studies from the 1970s and 1980s reached conflicting results. However, recent studies have exploited better data and more sophisticated statistical techniques. The modern refereed studies have consistently shown that capital punishment has a strong deterrent effect, with each execution deterring between 3 and 18 murders†¦ 2) Justice for the victim is achieved only through the death penalty. Refutation, opposition says it does not bring justice because mistakenly convict the innocent person With the life sentence the criminal somehow still gets back on the streets and then might kill again. The people who survive need a peace of mind that the person who committed the crime can never come after them again. ife sentence does not work out; the judicial system gives a person life sentence but somehow they get back on the streets and statistics show that nearly 30 convicted killers released from jail over the past 10 years have gone on to kill again thanks to the â€Å"fair† judicial system. Evidence Frederick A. Romano remembers his mother's panic-filled voice as she talked to his father, of himself grabbing the phone only to hear hi s father tell him that his older sister had been hurt. â€Å"It's justice,† Fred Romano said. â€Å"It's not revenge. † His wife, Vicki Romano, agreed, then elaborated. â€Å"Revenge would be going out and killing one of [the murderer's] family members,† Vicki Romano said. â€Å"The death penalty isn't revenge. It's the law. † FactsMarch 31st, 2009| | There are many reasons the death penalty should be abolished. It is a complex issue and it is difficult to point to any single fact or argument as the most important. 1) Executions are carried out at staggering cost to taxpayers. It costs far more to execute a person than to keep him or her in prison for life. A 2011 study found that California has spent more than $4 billion on capital punishment since it was reinstated in 1978 and that death penalty trials are 20 times more expensive than trials seeking a sentence of life in prison without possibility of parole. California currently spends $184 million on the death penalty each year and is on track to spend $1 billion in the next five years. 2) There is no credible evidence that capital punishment deters crime. Scientific studies have consistently failed to demonstrate that executions deter people from committing crime anymore than long prison sentences. Moreover, states without the death penalty have much lower murder rates. The South accounts for 80% of US executions and has the highest regional murder rate. 3) Innocent people have been convicted and executed. The wrongful execution of an innocent person is an injustice that can never be rectified. Since the reinstatement of the death penalty, 140 men and women have been released from Death Row nationally†¦. some only minutes away from execution. Moreover, in the past two years evidence has come to light which indicates that four men may have been wrongfully EXECUTED in recent years for crimes they did not commit. This error rate is simply appalling, and completely unacceptable, when we are talking about life and death. 4) Race plays a role in determining who lives and who dies. The race of the victim and the race of the defendant in capital cases are major factors in determining who is sentenced to die in this country. In 1990 a report from the General Accounting Office concluded that â€Å"in 82 percent of the studies [reviewed], race of the victim was found to influence the likelihood of being charged with capital murder or receiving the death penalty, i. . those who murdered whites were more likely to be sentenced to death than those who murdered blacks. † 5) The death penalty is applied at random. Politics, quality of legal counsel and the jurisdiction where a crime is committed are more often the determining factors in a death penalty case than the facts of the crime itself. The death penalty is a lethal lottery: of the 22,000 homicides committed every year approximately 150 peopl e are sentenced to death. 7) The USA is keeping company with notorious human rights abusers. The vast majority of countries in Western Europe, North America and South America — more than 139 nations worldwide — have abandoned capital punishment in law or in practice. The United States remains in the same company as Iraq, Iran and China as one of the major advocates and users of capital punishment. 8) Millions currently spent on the death penalty could be used to assist the families of murder victims. Many family members who have lost love ones to murder feel that the death penalty will not heal their wounds nor will it end their pain; the extended process prior to executions can prolong the agony experienced by the family. Funds now being used for the costly process of executions could be used to help families put their lives back together through counseling, restitution, crime victim hotlines, and other services addressing their needs. 9) Bad Lawyers are a Persistent Problem in Capital Cases Perhaps the most important factor in determining whether a defendant will receive the death penalty is the quality of the representation he or she is provided. Almost all defendants in capital cases cannot afford their own attorneys. In many cases, the appointed attorneys are overworked, underpaid, or lacking the trial experience required for death penalty cases. There have even been instances in which lawyers appointed to a death case were so inexperienced that they were completely unprepared for the sentencing phase of the trial. Other appointed attorneys have slept through parts of the trial, or arrived at the court under the influence of alcohol. 10) Life Without Parole is a Sensible Alternative to the Death Penalty In every state that retains the death penalty, jurors have the option of sentencing convicted capital murderers to life in prison without the possibility of parole. The sentence is cheaper to tax-payers and keeps violent offenders off the streets for good. Unlike the death penalty, a sentence of Life Without Parole also allows mistakes to be corrected. There are currently over 3,300 people in California who have received this alternative sentence, which also has a more limited appeals process last approximately 3 years. According to the California Governor's Office, only seven people sentenced to life without parole have been released since the state provided for this option in 1977, and this occurred because they were able to prove their innocence.

Halo and Devil Affect

Halo and Devil Effect Paper We live day to day knowing we live in a superficial society, from the way we look and dress and up to the way we present ourselves; we are always being judged in some form or fashion. Whether this is how you are treated by your social circle or in your employment seeking experience, its pretty sad that physical appearance can have and effect on so many things including the hiring process. In this essay I will be discussing two key concepts that are directly related to workplace discrimination based off of a persons physical appearance and characteristics. In the process of this I will view the film â€Å"The Devil Wears Prada† and discuss two scenes that illustrate my findings. The halo effect is the overall tendency to judge someone and favor him or her based on the bias of his or her positive characteristics or physical appearance without knowing the overall full package. The opposite affect of this concept is called the devil effect which is the te ndency to judge someone who could potentially have all of the qualifications for a position but wont be hired based off of his or her negative characteristics or physical appearance. While reading the article â€Å"Why looks are the last bastion of discrimination† this article definitely highlights on the halo and devil effect and discussed how weight came into play when determined if the interviewee should be hired or not.The job title was a school bus driver and it was determined without any concrete evidence that she could not evacuate a school bus in the event of an emergency situation, I find this completely bias on the companies behalf. Personally being a passenger on a school bus for many years during grade school, many of the school bus drivers where obese and not in the best of shape but, when any emergency situation arose mainly on and emergency school bus drills, they where able to perform the task of evacuating the bus in a safe and timely manner. This article also highlights other aspects of a study and how looks can play a major role in how people perceive a good looking or attractive person being viewed as intelligent, good and likable. Documented in this study obese individuals were rated to have a disadvantage in work, school and more. Among other findings in years of research, people who where unattractive where less likely to be hired and promoted and had lower salaries, even in fields where looks were not even of relevance. Another aspect of physical ttractiveness bias in hiring comes from the article â€Å"beauty is beastly†. There has been evidence suggesting that jobs traditionally filled my men, the opposite of the traditional bias happens to female applicants, attractive females are evaluated less favorably than unattractive females. This suggests that a more rugged female possibly comes across as being manlier or tomboyish making her easy to relate to traditional male positions such as a construction worker, firefighter, mechanic etc.I chose to watch the film â€Å"The devil wears prada† there was an obvious halo affect that was present; the job title was a personal assistant at Runway which is a very popular fashion magazine. When the applicant went into the office for her interview she was basically judged based on her since of fashion on weather she had the abilities to do that particular job even though she was college educated and had the qualifications to perform this job.I think the only reason why she was called back in and hired was because she asserted herself after the interview stating that she was not skinny, glamorous ect, but she was smart and a fast learner which are the important things. We know when going to an interview that we should dress in casual or business attire but you shouldn’t have to be dressed like a supermodel in order to get any job unless you are actually the model. The devil effect was depicted in this film when Andrea was out with a new found friend o ne night and he learned that she was working as Miranda Priestley’s assistant, he comment that she would never survive Miranda because she seems nice and smart and that she couldn’t do that job. I think many people think that’s just because someone comes off as being nice or relaxed cant handle aggressive or mean people but this definitely isn’t always true but with her being smart and educated can sometimes deem you over qualified for positions and not work in your favor but in this situation it was not the case.My personal connection to the halo effect was while in the military, being in the military you learn from basic training that looking sharp in your uniform can show how much pride you have in the service. There are also many awards that you can obtain depending on how sharp your uniform looks, how well you perform your job duties and on up to having outstanding military bearing. In order to win awards you have to compete with a number of your pee rs and who ever has the most recognition win.I had been nominated for several awards while in the military and most of the time I won because they always told me I was always sharp with my uniform pressed and creased and always respectful. The halo and devil effect is constantly seen in our society, this will be an on going issue that will probably never change because we live with a judgmental state of mind that constantly makes snap judgments on individuals, so the next time you are in a situation remember try not to judge someone based on there positive or negative characteristics try getting to know them first.

The Rising of the Moon

The Rising of the Moon was a very interesting play. The setting takes place on a dock at night. There is very little lighting on the dock and the only object on the dock is a barrel. We start with three policeman, a Sargent and two regular officers. The two regular officers are posting fliers of an escaped prisoner. There is a reward mentioned on the fliers which is substantial and the officers talk about this and the possibility of a promotion for the one who brings in the fugitive. The two regular police officers leave the Sargent alone on the dock to go about posting more fliers. The Sargent staying to thwart a possible escape route for the escapee. Enter the ragged man posing as a ballad singer. He tries to walk past the Sargent but is stopped and asked his business. He explains that he wants to sell songs to sailors as they return to their ships from leave. A conversation ensues between them.As I was reading the play I first thought that the two main characters (the police Sargen t and the ragged man) may have know one another. It was when the ragged man began to sing the ballad â€Å"Granuaile† (pronounced graw nya wail) and I found that it was a patriotic ballad that it struck me that the whole meaning was rebellion against English rule. The police Sargent Irish working to keep law and order for England. The ragged man Irish patriot or rebel. During their vebal exchanges the ragged man confesses that he is indeed the wanted criminal. He removes his disguise handing it to the Sargent (the disguise performs the entire journey towards the discovery of the Sargent's â€Å"true† identity underneath his mask of law and duty; the use and exchange of the disguise are similar to the exchanges of identity between the Irish man representing British rule and the Irish man representing the rebellion. [Marina, June, 2005] ) At the very moment the two regular officers are heard returning the ragged man hides behind the barrel the only thing between escape or imprisonment. The officers coming near with a lamp are stopped by the Sargent and he tells them he would rather be alone bidding them to leave as their noise may scare the wanted man. A kind of tug of war ensues about leaving the lamp, the officers want to leave it and the Sargent does not want it. It swings back and forth the Sargent afraid that the man behind the barrel might be exposed. The Sargent bellows â€Å"Be off the two of you, yourselves and your lantern! † They leave. The ragged man raises from behind the barrel thanks the Sargent, tells him he owes he one in return, waves his hand and disappears into the night. The Sargent second guessing himself says, â€Å"A hundred pounds reward! a hundred pounds! I wonder, now, am I a great a fool as I think I am? † I think not, he gave in to his national pride and deep down he regrets it not! Bravo! There were four main points in this drama. The rising of the moon: Was it night that was being emphasized? Was it to make the escape easier? Was it a symbol for the darkness of the British occupation? Or the darkness in the lives of the Sargent and the ragged man. The barrel: A large barrel, was it only a place to hide behind? Or the symbol of the road to freedom or imprisonment. The ballet â€Å"Granuaile†: A patriotic song based on â€Å"one of the most remarkable women in Irish history†. (BabyNamesofIreland. com) The disguise: The hat and the wig. Is the Sargent really fooled. Is it a symbol for the mask that the Sargent is hiding behind? On the rising of the moon, I believe this is the rising from oppression from British rule. The ragged man at the end of the play tells the Sargent, â€Å"Maybe I'll be able to do as much for you when the small rise up and the big fall down†¦ when we all change places at the rising of the moon. † The barrel is where the ragged man hides behind when the other two policemen come back.I believe it was not only hiding the ragged man but the Sar gent's true inner feelings of patriotism. The ballet unites the two as Irishman and as they share a pipe the Sargent corrects the ragged man when he miss sung some lyrics and the Sargent corrected him. The disguise performs the entire journey towards the discovery of the Sargent's â€Å"true† identity underneath his mask of law and duty; the use and exchange of the disguise are similar to the exchanges of identity between the Irish man representing British rule and the Irish man representing the rebellion. Green Ox Essay

The new products division of Palmer Jackson, Inc. , a Cincinnati-based food and beverages manufacturer, successfully perfect a technique for dissolving common antioxidants such as Vitamin E and Selenium into high-glucose beverages. As a result a new line of sports beverages with added benefit of antioxidants occur. Palmer Jackson hired AccuityBrand, a brand consultancy specializing in developing product names and logos, to name and develop creative packaging for this new product. The new beverage was named Green Ox, and after a short discussion with management, the name was approved. Now that the name Green Ox was approved by the management Palmer Jackson needed to make several important decisions about the introduction of the new product. Palmer Jackson hired Marketing Studies Incorporated (MSI), a well-respected marketing research firm, to work on this product and to provide some basic competitive intelligence. Management believed the main competitors of Green Ox were recognized sports drinks and some vegetable juices, most particularly V7 and surprisingly strong interest among those who currently purchase antioxidants in pill form. Research conducted by MSI that up to10% of the people who purchased antioxidants in pill form would be interested in obtaining these vitamins and minerals from beverage rather than a pill. The objective of this case is to make a new beverage to compare it to the other old beverages that track record of successful sales in other channels. This is to test whether the new product is more efficient than the others. Where, the Green Ox successfully perfected a technique to dissolve common antioxidants into high-glucose beverage The campaign we want to launch for the new line of products seeks to distinguish â€Å"Green Ox† from its rivals by promoting its antioxidant content. The promotion will be designed, firstly to drive awareness of Green Ox and its key point of differentiation: antioxidants. We will use advertising for education. A website will e created which will five all the information about the products ad their benefits for heath and physical conditioning. Because of antioxidants content, Green Ox is a functional drink that is truly different from its competitors. Palmer Jackson realizes that product, price distribution, and promotion decisions for Green Ox all rely on the decisions they make, that all four of the †P† decisions are tangled and depend on each other. They feel that the place to start is with some notion of how many flavors of Green Ox they should introduce and at what price. The problem exist because of the several social trends that the senior management at Palmer Jackson believed might be important in determining the success and growth potential of Green Ox. Some problems that the company encountered are to decide quickly the segment(s) to target, and how the product would be positioned in the minds of its potential consumers. It also needed to decide how the product would be priced to the retailer as well as how many flavors should be introduced. Complicating matters was management’s keen understanding that all of these decisions depended on each other. Alternative identification and evaluation The company can solve the problem by managing their time in deciding what seems to be the exact target. The company should also be active and responsible enough to know what price and how it will be presentable to the potential consumers. Even in complicated matters the management should be open-minded and they must agree among themselves every decision that they make. These are the advantages of the product: it has more benefits added to their product than the V7 products; it produces new flavor; even though it’s expensive it is worth it; it is also a good alternative for the other sports drinks. We will use advertising for education. A website will be created which will five all the information about the products and their benefits for health and physical conditioning. The whole campaign will emphasize our competitive advantage. Solution Conclusion: Palmer Jackson Inc has developed a new line of sports beverages which have the added benefit of antioxidants. They have developed several elements of their brand strategy with the agency Accuity Brands which is a branding consultancy, where there are marketing strategy specialists. They have also hired Marketing Studies Incorporated, a well-respected marketing research firm, to work with the management team. The most important issue for Palmer Jackson Inc is the positioning and segmentation of their new drink, Green Ox. There are three main competitive markets: Sport Drink, Antioxidant & V7 in which Green Ox will compete for market share.

An Analysis of Hughes and Gullos Article on Joyful Learning and Assessment in Kindergarten

An Analysis of Hughes and Gullo's Article on Joyful Learning and Assessment in Kindergarten Joyful Learning and Assessment in Kindergarten, Hughes and Gullo Hughes and Gullo begin their article by painting a picture for us of the increase in prekindergarten enrollment numbers. More and more three and four year olds are being enrolled in kindergarten preparedness programs, such as pre-k or More at Four. They also point out the sharp increase in state mandated age cut-offs for kindergarten enrollment. These changes are both illustrative of how kindergarten academic standards have jumped up significantly in the past few years. Hughes and Gullo tell us that kindergarteners are now primarily taught through academically oriented teacher-directed instruction rather than developmentally appropriate methods of learning. They explain that these dramatic changes in the way kindergartners are taught are believed to be because of the inappropriate assessment tools used to gauge kindergartner’s academic progress. These developmentally inappropriate tools of assessment such as standardized testing and worksheets can be traded in for more appro priate means of assessment for kindergartners. Hughes and Gullo use the rest of their article to explain different characteristics of assessment and how we can adjust our means of assessment to promote individual development amongst kindergarteners. Hughes and Gullo define assessment to further expand our understanding of the issue- â€Å"the progress of a child’s learning over time.† Testing children at the end of a unit undermines this definition of assessment. The authors tell us that learning is a continuum and that assessment be used to help teachers identify where children are individually on that learning continuum. This can be done by learning and recognizing children’s learning sequences and using frequent â€Å"embedded† assessments to gauge their mastery of classroom concepts. The authors of the article go on to explain to us that assessment is a comprehensive process- one simple test or type of assessment will not measure the many areas of learning that need to be measured to determine comprehension. In the final section of the article, Hughes and Gullo tell us that assessment should be integrated into the process of the activities being assessed. By doing this, teachers can use assessme nt to change lessons to suit the individual needs of children, and teachers can see firsthand how effective or ineffective their curriculum is. Hughes and Gullo give an example of a teacher that uses assessment to plan activities based on her student’s interests, experiences, and skills. Hughes and Gullo end their article with a powerful statement: appropriate assessment can lead to joyful learning and joyful teaching.

Family Law Essay Example | Topics and Well Written Essays - 4000 words

Family Law - Essay Example The only ground for divorce is the irretrievable breakdown of the marriage which must be proven by at least one of five facts.2 Adultery is one of the five facts capable of proving that the marriage has irretrievably broken down.3 However, using adultery to substantiate that the marriage has irretrievably broken down may be problematic for two specific reasons. First, the allegation that Mr. Murdock has been engaged in several adulterous relationships in the past with the last one ending at least 8 months previously is statute barred. Pursuant to Section 2(1) of the Matrimonial Causes Act 1973, a party is not entitled to plead adultery, if having found out about the adultery, the party seeking to rely on adultery continued to live with the other party for at least 6 months.4 Thus, if Mr. Murdock wanted to rely on your adultery with his son Stuart from several years earlier, he would be time barred since he continued to live with you for more than six months after learning of the affa ir. However, the court may disregard this fact if the adultery is such that the petitioner finds living with the respondent intolerable. Or the adultery may be pleaded as evidence of the breakdown of the marriage or as evidence that the marriage has irretrievably broken down.5 The fact that the adultery has been ongoing for a number of years and the respondent is believed to be currently conducting a sexual affair with his office manager may be sufficient for proving that the pervious adulterous relations are statute barred, are nonetheless intolerable. Even so, the alleged current adulterous relationship can constitute a second fact capable of supporting the ground of the irretrievable breakdown of the marriage. The problem with pleading adultery is that the courts require proof of the adultery. The standard is based on the civil standard which requires evidence showing that on a balance of probabilities, the respondent has committed adultery. Thus, an admission of adultery by the respondent would be sufficient proof.6 At this point, Mr. Murdock has neither admitted or denied the adultery with his office manager, but simply stated that it was none of your business. He may however decide to admit to adultery since he states that he no longer wants to remain married to you. Aside from adultery, there appears to be sufficient evidence of behaviour pursuant to Section 1(2)(b) of the Matrimonial Causes Act 1973. Section 1(2)(b) provides that the breakdown of a marriage can be proved if the court is satisfied that: The respondent behaved in such a way that the petitioner cannot reasonably be expected to live with the respondent.7 This section has been interpreted to mean that it is not so much the respondent’s behaviour that concerns the court, but the petitioner’s feelings relative to living with the behaviour.8 Thus the fact that you have suffered depression since giving birth to Jack, the first child of the marriage, suggest that you might find liv ing with the physical and verbal abuse intolerable and thus provide

Designing Interventions Essay Example | Topics and Well Written Essays - 500 words

Designing Interventions - Essay Example Short term strategies should be dependent on management in its implementation whereas long term strategies should be dependant on external experts for implementation. Finally, it was realized that the intervention might in the short while bring some hardship on the economic fortunes of the company but in the long term there shall be productive benefits to be enjoyed by the company. The search for development in the midst of problems and challenges such as the one described faced by the organization is a whole system that demands carefully delivered models and processes to overturn. It is in this direction that the application of organizational development process skills by the executives of the organization becomes very necessary. As noted by the Office of State Personnel, North Carolina (2008), â€Å"the organizational development process is based on the action research model which begins with an identified problem or need for change.† This means a variety of skills that includes, assessment, planning, implementing the intervention, gathering data to evaluate the intervention, and determining if satisfactory progress has been made or if there is need for further intervention must all be used (Office of State Personnel, North Carolina, 2008 ). In brief, the executives of the organization must be on a search for a suitable intervention that addresses all aspects of the identified problem without leaving marginalized implications to the organization. The various stages and skills that need to be exhibited in this quest have been illustrated below. The intervention, or otherwise referred to as change strategy to be developed through the stages and skills discussed above need to be executed through short-term and long-term approaches. These long term and short term approaches can be summed up in two major forms of change strategies namely

Military Leadership in the Union Armies Term Paper

Military Leadership in the Union Armies - Term Paper Example The battle continued for four years from year 1861 to 1865 and then ended with the surrender of the Confederate and outlawed slavery throughout the Country.1 Union party was served by more than 2.2 million military men, whereas approx 1.4 million people fought from Confederate side. The military personnel had gained professional military education and worked under the leadership of officers from diverse backgrounds. These military officers were professionally trained West Pointers, businesses persons and political officials. Initially confederate had strong leadership, but Union had led by poor commanders. Later on, Union replaced such officials and employed adept and potential military men who had command experience, thereby brought victory to the Union.2 This paper analyzes battlefield strategy and leadership of Military officials in Union Army which led the forces to defeat Confederate men. The US Civil War never faced shortfall of enthusiasm because many young people wanted to jo in the army in 1861. All these people volunteered because they were excited to fight in defense of the Union military force, in anticipation of quick promotions as lead by their experience. The trouble created in the process of volunteering was a severe lack of leadership, planning and organization at the loftiest levels.3 The American Civil War supplied a multitude of commanders and sensible comparison amid battle conditions and issues. The Union military army had a specific requirement for efficacious armed combat commanders during the Civil War and those commanders and officers were essentially needed to be specifically educated and well trained to lead the people in war which would in turn defend and uphold the new nation. This unique need was realized and understood by government and politicians, so they made efforts for military training.4 Though, all military leaders had not developed through gaining formal military education and training. Many cells of professional officials were formed by the United States Naval Academy at Annapolis and the United States Military Academy at West Point. These cells were comprised of professional military officers who had complete knowledge of military science so as to create an intense impact on the demeanor of the American Civil War. Throughout the Civil War, Abraham Lincoln was the President of United States and at the same time served as the Commander-in-Chief of the Union armed forces, the highest-ranking military officer .5 The military personnel had the authority to elect the junior officers, whereas the state governors nominated the senior officers, and the President Lincoln nominated the generals.6 The significant military leaders for the Union army included Ulysses S. Grant, William T. Sherman, George B. McClellan, George Meade, John C. Fremont, Ambrose Burnside, Joseph Hooker, Irvin McDowell, and Winfield Scott.7 This paper throws light especially on the role played by Generals George B. McClellan, Ulysses S. Grant, George Meade, and William T. Sherman. During the American Civil War, George Brinton McClellan was a major general. He served as the general-in-chief of the Union Army for a short period from November 1861 to March 1862, and coordinated the renowned Army of the Potomac. In the beginning of the war, McClellan’s attempts for raising a well-trained and devised army for the Union had been very important. Peninsula Campaign initiated by McClellan in 1862 got failed, as his army receded due to

Construction Related topic - Essay Example In an online source, Wikipedia, it states that "Before this time bricks were generally made as close as possible to their point of intended use (it has been estimated that in England in the eighteenth century carrying bricks by horse and cart for ten miles over the poor roads then existing could more than double their price)." Woody Harrelson says in the movie Indecent Proposal (1993), "A common, ordinary brick wants to be something more than it is." This statement conforms to the recent developments organised by the Brick Development Association (BDA), who represents the UK brick industry, looks for new and modern ways on how to utilise effectively this versatile construction material. BDA is the working group in developing the codes of practice for clay masonry and pavers units. Continues efforts are employed in exploring new products and mixtures for brick by the group since brick is one of Europe's most popular building materials remain intact. Many researches were conducted to explore different mixtures for brick and managing recycled brick. Recycled clay brick aggregates for use in concrete is one of the by-products of bricks that were experimented.
